Terms of Service

The rules that govern use of our U.S. online store, purchases, promotions, content, and customer relationship.

Effective October 11, 2026

1. Store operator and eligibility

Avelur & Co. is a brand operated by Avelur & Co (“Avelur,” “we,” “us,” or “our”). You must be at least the age of majority in your state of residence, or use the Services with the involvement of a parent or legal guardian, to make a purchase.

2. Online store terms

You may use the Services only for lawful, personal purposes. You may not interfere with site security, introduce malicious code, scrape the site in a way that harms operations, impersonate another person, use fraudulent payment information, or violate applicable law or another person’s rights.

3. Product information

We make reasonable efforts to present descriptions, dimensions, materials, finishes, colors, and images accurately. Screen settings, lighting, handmade or manufacturing variation, and photography can cause minor differences. Such differences are not necessarily defects.

Follow all product instructions and warnings. For lighted seasonal décor, use only the specified battery type or power source; keep battery compartments and electrical components away from conditions not permitted by the product label; do not modify wiring; and keep products away from open flame, excessive heat, and unsupervised children or pets. Indoor or outdoor suitability is determined solely by the product instructions.

4. Prices, taxes, and payment

Prices on the U.S. storefront are stated in U.S. dollars unless otherwise shown. Applicable taxes, shipping charges, and discounts are calculated at checkout. We may correct pricing, description, or inventory errors before fulfillment. If a correction materially affects your order, we will contact you and provide the options required by law.

You represent that payment and billing information is accurate and that you are authorized to use the payment method submitted. Payment is processed by Shopify and other payment providers under their own terms.

5. Orders and acceptance

An order confirmation acknowledges receipt but does not guarantee acceptance. We may reject or cancel an order for legitimate reasons, including suspected fraud, inventory error, pricing error, resale activity, payment failure, or an address we cannot serve. If we cancel after payment, we will refund the canceled amount to the original payment method.

We may limit quantities per person, household, payment method, address, or order where reasonably necessary.

6. Promotions and bundles

Promotions are subject to the terms displayed with the offer, availability, and stated dates. Unless checkout expressly allows otherwise, promotions cannot be combined, transferred, redeemed for cash, or applied retroactively.

For a “Buy 2, Get 1 Free” offer, the qualifying quantity and selected variants must be included in the promotional bundle. If part of a bundle is returned, the refund may be recalculated to reflect the promotional value of items kept. See our Returns & Refunds Policy.

7. Shipping, title, and risk

Shipping options and estimates appear at checkout and are governed by our Shipping & Delivery Policy. If no shipping timeframe is stated, we will ship within the period required by applicable law. Title and risk of loss transfer as provided by applicable law and carrier arrangements; nothing in these Terms limits non-waivable consumer rights.

8. Returns, refunds, and product concerns

Eligible returns are governed by our Returns & Refunds Policy, including the 30-day request window, condition requirements, bundle treatment, and procedures for damaged, defective, incomplete, or incorrect items.

9. Accounts and communications

You are responsible for maintaining the confidentiality of account credentials and for activity under your account. Notify us promptly of suspected unauthorized use.

By providing contact information, you agree to receive transactional communications related to orders, security, support, and policy updates. Marketing messages are subject to your choices, and promotional emails include an unsubscribe method.

10. Reviews, submissions, and user content

If you submit a review, photo, video, comment, or other content, you confirm that you own it or have permission to share it and that it is accurate, lawful, and does not violate another person’s rights. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, display, adapt, and use that content in connection with the Services and our marketing, subject to applicable law and any separate written agreement.

We may moderate or remove content that is unlawful, misleading, abusive, unrelated, infringing, or contains personal information, but we are not obligated to publish every submission.

11. Intellectual property

The Avelur & Co. name, logos, visual identity, product presentation, site design, text, graphics, photographs, and other content are owned by or licensed to us and protected by applicable intellectual-property laws. No right is granted except the limited right to use the Services for personal, non-commercial purposes.

12. Third-party services and links

The Services may rely on or link to third parties such as Shopify, payment processors, carriers, social platforms, and analytics services. Their services and policies are controlled by them. We are not responsible for third-party sites or services except to the extent responsibility cannot be excluded by law.

13. Disclaimer of warranties

Except for express written warranties and rights that cannot be excluded, the Services and site content are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. This section does not limit the 30-day return commitment stated in our Returns & Refunds Policy or any mandatory consumer protection.

14. Limitation of liability

To the maximum extent permitted by law, Avelur and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits or data, arising from the Services or a product. Where liability cannot be excluded, our aggregate liability will not exceed the amount paid for the product or service giving rise to the claim.

Some states do not allow certain warranty exclusions or liability limitations, so portions of this section may not apply to you.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold Avelur harmless from third-party claims arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights. This does not apply to claims caused by our own wrongful conduct.

16. Website Availability and Disclaimer

We use commercially reasonable efforts to keep the Avelur & Co. website, checkout, account features, and digital content available and operating reliably. However, these services may occasionally be interrupted, delayed, unavailable, or affected by maintenance, technical issues, third-party providers, or circumstances beyond our reasonable control.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND RELATED DIGITAL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DO NOT GUARANTEE UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, COMPLETE SECURITY, OR COMPATIBILITY WITH EVERY DEVICE, BROWSER, OR NETWORK.

This website disclaimer applies only to the website and related digital services. It does not exclude or limit any warranty, remedy, or consumer right relating to a product that cannot lawfully be excluded under applicable federal or state law.

Any express written product warranty offered by Avelur & Co. will be presented separately and made available as required by applicable law.

Some states do not permit certain warranty exclusions or limitations. Therefore, some or all of the language above may not apply to you, and you may have additional rights under the laws of your state.

17. Changes and severability

We may update these Terms prospectively by posting a revised version with a new effective date. If any provision is held unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect.

18. Entire agreement and contact
